Man in False Sex Abuse Case Criticizes Coakley’s Role in Preventing His Commutation

Politico: In the 1980s, Violet Amirault and her children, Gerald Amirault and Cheryl Amirault LeFave, were convicted of sexually abusing several children at their day care facility. The cases came at the height of the 1980s sex abuse panic, leading to false convictions across the country based on improper questioning of children, mass hysteria about sex abuse and Satan worship, and bogus “recovered-memory” psychotherapy. [Martha] Coakley didn’t prosecute the Amiraults; her former boss Scott Harshbarger did. But the case against the family began to come apart during her tenure as district attorney. Despite a parole board’s 5-0 recommendation to grant Gerald Amirault clemency and mounting doubts about the evidence against him, Coakley publicly and aggressively lobbied then-Gov. Jane Swift to deny Amirault relief. Amirault remained in prison.

How could anyone ever vote for this woman?

Read this about Martha Coakley the Democratic Liberal from Massachusetts who wants the Senate seat next Tuesday.
http://bigjournalism.com/

As a public service to the voters of the Bay State, during the run-up to the special election on Jan. 19, “Big Journalism” will be offering some of the Martha’s Greatest Hits, so that they can fully make up their minds whether she would make a suitable successor to the late Edward Moore Kennedy – who, as you recall, began his illustrious career by being expelled from Harvard for cheating, went on to drown Mary Jo Kopechne at Chappaquiddick, and then turned to a life of drinking and debauchery, including the infamous “waitress sandwich” with soon-to-be-retired Connecticut Senator Christopher Dodd, before attempting to inflict “universal health care” on the country shortly before his death last year.

You can read all about Ted here in this classic profile of the last and worst of the Kennedy brothers by the late Michael Kelly. Be sure to read the whole thing, just to get a flavor of the kind of candidate Massachusetts voters seem to like.

Homework done? Good. Because Martha Coakley, the current Attorney General of the Commonwealth of Massachusetts, and thus its top law enforcement officer, is shaping up as a worthy heir to the Lion of the Senate.

Let’s start with a horrific case that shows Coakley’s inexplicable and appalling lack of judgment:

1. October 2005: The curling-iron toddler rape case. Coakley brings no charges, then lets the rapist out on no bail.

“I’ve been a cop for over 26 years and this is one of the most — if not the most — horrific cases I’ve ever seen.” Police Detective Sgt. Barry Campbell

Even in a place like Boston, which has seen its share of horrific sex crimes in recent years, such as the Jeffrey Curley rape and murder in 1997, this was particularly unsettling. Meet Keith Winfield, child rapist:

In October 2005, a Somerville police officer living in Melrose raped his 23-month-old niece with a hot object, most likely a curling iron.

Keith Winfield, then 31, told police he was alone with the toddler that day and made additional statements that would ultimately be used to convict him.

But in the aftermath of the crime, a Middlesex County grand jury overseen by Martha Coakley, then the district attorney, investigated without taking action.

It was only after the toddler’s mother filed applications for criminal complaints that Coakley won grand jury indictments charging rape and assault and battery.

Even then, nearly 10 months after the crime, Coakley’s office recommended that Winfield be released on personal recognizance, with no cash bail. He remained free until December 2007, when Coakley’s successor as district attorney won a conviction and two life terms.

Coakley, now the Democratic candidate for US Senate, has made much of her record prosecuting crimes against children, and says her office handled this investigation appropriately. But the case stands out as one in which she drew criticism for not being aggressive enough. Indeed, the case gave rise to Coakley’s last competitive election.

One of the attorneys who had represented the family of Jeffrey Curley was so outraged at Coakley’s inaction in the Winfield case that he challenged Coakley in her run for A.G. in 2006, but lost.

After Coakley’s foot-dragging, Winfield eventually was found guilty on all four charges of the August 2006 indictment: two counts of rape of a child with force, one count of indecent assault and battery on a child under 14, and assault and battery with a dangerous weapon causing serious bodily injury. He was sentenced to two life terms

So let’s be clear: Martha Coakley failed to take action against a man who molested his own niece, a child, with a curling iron until her hand was finally forced by the victim’s mother.

And that’s just the beginning. Stay tuned for Part Two…

Snailmailtrucker   January 14th, 2010 - 5:12 pm

OK, so let me get this right…

Martha Coakley refuses to prosecute a child molestor who is without a doubt guilty and leaves him on the street….and she refuses to release a man falsly accused even when the ENTIRE PAROLE BOARD voted to release, and leaves him in prison.

Sounds like a resume’ for a Presidential Candidate for the Democratic Party to me!

change monger   January 14th, 2010 - 5:15 pm

The hits just keep on coming!!!

I’m guessing this will be in Gary Hewsons “Martha’s Greatist Hits” series over at Big Journalism. I encourage any voter from Mass. to check it out.

Fosetta Ftone   January 14th, 2010 - 5:25 pm

She will go no place but up in the party of change.

Gandhi's Fist   January 14th, 2010 - 5:28 pm

Just another notch in the belt that is Coakley’s incompetence. The bias, lies and corruption of MA dems are monumental even by Boss Tweed standards. Brown will have to win it by a clear 10% to actually win it as that actual proportion will amount to a dead heat at the voting booth. No one can manufacture a vote like a dem.

The liberal polls have Brown at less than 15 points behind Coakley, which means, he is actually doing a few points better than here. The poll is another tool the dems use to flog the populous with influence as to how they should vote. We can only hope the people of MA have gotten their collective acts together and made a return ot common sense. Brown is the better leader, quicker on his feet intellectually and–without a doubt–classier.

The “Kennedy Seat” as the biased news media call it, is the people’s seat and for that civics lesson alone he should win office. I party that holds amongst its leadership in MA: Kennedy, Kerry and Frank, it is pretty obvious they can do so much better. Open your eyes, minds and attitudes MA, this is the change that ia sorrily needed, perhaps the only hope to derail a socialist juggernaut unlike any before it.

I was waiting for this guy to speak up. If I were him I’d be pissed off and extremely vocal about it.

bulldawg   January 14th, 2010 - 5:36 pm

And Massachusetts wants to make this Socialist their next Senator. Sounds like a move right out of the Obama play book. You know Holder wants to try terrorist as ordinary citizens and let Barney and Chris go free. Massachusetts wake up and vote this idiot out not in. http://www.givemeliberty2010.com

LaRue   January 14th, 2010 - 6:11 pm

I don’t see the idiots in Massachussetts voting for Brown. The Kennedy die-nasty will somehow prevail from the grave of that old reprobate to keep the reins of power. Some day, when all those aholes die off, sanity might prevail. Coakley is just another tool in Obama’s pocket.

roger bannister   January 14th, 2010 - 6:29 pm

Excuse me…. but where did the American Revolution originate? Wasn’t there some massacre in Boston? Isn’t Boston in Massachusetts? Didn’t they kinda value individual liberty up there?

Is there something in the water up there (apart from Mary Jo Kopechne?)

kolbee123   January 14th, 2010 - 7:08 pm

I was wrongly convicted of a federal crime by Judge Huff in San Diego in the mid-90’s. She told others close to her that she believed I was innocent, but if she dismissed my case the prosecutor would fight her nomination to Chief Judge. So I know exactly what this guy is going through. Our judges and prosecutors don’t give a flying f*** about the truth, they only care if THEY win. Coakley doesn’t give a f*** about the people of Mass., only if she wins. Screw ‘em all.

Esteban Cafe, World   January 14th, 2010 - 7:28 pm

Unfortunately, there are far too many dead voters in MA for Mr. Brown to win. And the fact that SEIU is involved means that ACORN is involved.
They received their funding and sneer at your Constituion. You Americans have unionized your voting practices; there is NO way for Mr. Brown to win this.
It will be a reprise of the Minnisota Comedian’s victory; it will start out that Brown won, but by the time the recount is over, it will be Coakly
by 10%. I am sorry for your great country. Good luck.

You must remember that the majority of the people in Massachusetts are Useful Idiots and Tools of the Liberal/Communists in this country. All they need is a nod or a song from their Kenyan Commie Comrade, they will be lining up like Lemmings ready for slaughter. Stupid is as Stupid Dose. With that said, Coakley will win.

Corky   January 14th, 2010 - 8:35 pm

After being in jail for 15 years, I would be suing a department for their reckless so called investigation by officers and caseworkers.

resonable dems of mass. this is your chance to be rid of the false kennedy mythology, get rid of the aristocracy, you the people have the power not them. they have only there own interest at heart, not yours. be a hero for your state ,and country, vote brown and get your country back from these commies.

KC   January 15th, 2010 - 12:02 am

No way Brown wins this. He would need to beat her by double digits to have a chance. If it’s in the single digits, the dems will magically “find” the needed votes. Then, the very second Coakly has a lead, the race will be declared over. A certain Minnesota senator is very familiar with this “strategy.”

stop child abuse   January 15th, 2010 - 8:05 am

Amirault was found guilty by more than one judicial review by both political parties. There were physical findings of abuse in the children, the children exhibited strong sexualized behaviors after the abuse, nine children testified that they were abused and as adults they still continue to say they were abused. see http://eassurvey.wordpress.com/2010/01/10/fells-acres-%E2%80%93-amirault-case/ for more information

Letters to the Editor: The Real Darkness Is Child Abuse WALL STREET JOURNAL 02/24/95 Hardoon
The three Amiraults — Gerald, Violet and Cheryl – were convicted after two trials before different judges and juries almost one year apart. They were represented by able and well-known defense counsel. The convictions were upheld after review by state and federal appellate courts…in Amirault, the majority of the female children who testified had some relevant physical findings, as did several female children involved in the investigation who did not participate in the trial. The findings included labial adhesions and hymenal scarring …The victims and their families in these cases have been irrevocably harmed by what was done to them by the Amiraults. Every argument raised by Ms. Rabinowitz was ably presented by the defense at the trials. The juries, by their verdicts, rejected these arguments. Justice was done.

Amirault was guilty   January 16th, 2010 - 12:58 am

It is sad that this case is being spun against the victims of these crimes for political reasons. Regardless of what one thinks of Coakley, Amirault was found guilty and his conviction was upheld by both parties (including Republican Jane Swift). The victims have suffered enough. Stop defending convicted child abusers and start defending abused children.

Mass. Victims Fight Commutation Plea By Leslie Miller, Associated Press Writer
CAMBRIDGE, Mass. (AP) – Victims in the Fells Acres child abuse case broke down Thursday as they described their pain publicly for the first time in hopes of keeping the last person convicted in the case behind bars. Victims urged her to keep Amirault in prison. “During counseling meetings as a child, I would speak of a tall man touching me and taking pictures of me,” Phaedra Hopkins, 20, said at an emotional news conference. “So many times, Mr. Amirault hovered over me, touched me and hurt me and committed many disgusting acts of abuse.” Those children, now adults, stood by their testimony Thursday.

Governor explains Amirault decision Says she needed to ‘live with myself’ By Douglas Belkin and Frank Phillips, Globe Staff, 2/21/2002
In her announcement, Swift said her first consideration was whether there was ”overwhelming evidence” to contradict the jury conviction and two decisions by the Supreme Judicial Court upholding the verdict.

Swift won’t free Tooky by David R. Guarino and Elisabeth J. Beardsley Wednesday, February 20, 2002 Convicted child molester Gerald “Tooky” Amirault lost his best shot at freedom yesterday, denied commutation of his sentence by acting Gov. Jane M. Swift in another stunning turn to the roller coaster abuse case. Swift rejected the unanimous July Parole Board recommendation that there was “real and substantial doubt” of Amirault’s guilt. Taking sides in a highly charged case as she drops in election-year polls, Swift said Amirault should be jailed at least until he’s up for parole in 2004 on his 30- to 40-year sentence. “She carefully analyzed every bit of information generated through the investigation and came to her decision that the verdict was just and the sentence was appropriate,” said Swift spokesman James Borghesani….victims rejoiced last night, praising the acting governor for standing up to the Parole Board and claiming vindication after years of doubts about the case. “All along, they’ve always told the truth,” said Harriet Dell’Anno of Lynn, whose daughter, Jamie, remains in therapy over the incidents. Barbara Standke of Tewksbury, whose son, Brian Martinello, was molested when he was 4, said, “He may be doing 20 years, but my son’s doing life.” Amirault, his sister, Cheryl LeFave, and their mother, Violet, were convicted after a parade of children told horror stories about being fondled, raped.

COMMONWEALTH vs. GERALD AMIRAULT. 404 Mass. 221 December 6, 1988 – March 6, 1989
The children complained and cried about the school; they complained of stomachaches, headaches, pain in their genital areas, and bowel problems. They began bedwetting, lost their appetites, had nightmares, used baby talk, became fearful of lights, of men, and of being left alone. The children also displayed sexually explicit behavior; some began masturbating. Two of the boys tried to stick their tongues into their mothers’ mouths

COMMONWEALTH vs. VIOLET AMIRAULT (and eleven companion cases [Note 1]). COMMONWEALTH vs. GERALD AMIRAULT. 424 Mass. 618 October 9, 1996 – March 24, 1997 The Commonwealth also presented a pediatric gynecologist and pediatrician who examined five of the girls who testified against Gerald. She made findings consistent with abuse in four of the girls….The parents of several children testified that their children developed pronounced sexual behavior and regressed to infantile behaviors such as bedwetting and baby talk. The same child psychiatrist who appeared at Gerald’s trial testified that these behaviors were commonly indicative of sexual abuse.
