This is the definition of progressivism, defining law based on case work rather than on principles. And this is where judicial activism starts. The Constitution is not a baseline from which to build jurisprudence, it is the ruler by which laws are judged. The fact that she doesn’t understand that means she’s not qualified for the court.

I was all set to get furious about this, but–I can’t. I’m no Kagan supporter and certainly no liberal, BUT, as Solicitor General, it is Ms. Kagan’s job to defend the laws of the U.S. government in court. I disagree thoroughly with the law and I was thrilled when it was overturned, and Ms. Kagan’s argument is ridiculous (and in the face of all precedent), but the only thing I can criticize her for is not thinking up a better response. There is no indication that she BELIEVES the argument she is making. So, I can’t call her a fascist until she makes the argument on her own, outside of her job defending the United States. I do think she is unqualified to be a Justice, but because she doesn’t seem to know legal precedent, not because she wants to ban books.

Sounds like the Court is examining a campaign spending law that includes limits on organizations’ campaigning during or right before elections. Kagan seems to be saying that there is no issue as related to books because the FEC has no intention of going after books.
