This would be in effect a giant constitutional failure and would proabably plunge the national into civil conflict. Creating a new slave class out of Medical Personell. Why aren’t Constitution-defending patriots pointing out the following? Given that the federal Constitution is silent about public healthcare, the 10th Amendment automatically reserves government power to regulate and lay taxes for healthcare to the states, not the Oval Office and Congress.

In fact, Chief Justice Marshall had established the following case precedent, now wrongly ignored, which appropriately limits the power of the feds to lay taxes.

“Congress is not empowered to tax for those purposes which are within the exclusive province of the States.” –Chief Justice Marshall, GIBBONS V. OGDEN (1824) http://supreme.justia.com/us/22/1/case.html

So not only is misguided Obama’s proposed healthcare constitutionally unauthorized, but based on Justice Marshall’s official words, Congress never had the power to lay taxes to fund such a program in the first place.

What the Constitution does allow, as evidenced by RomneyCare, is the following. We should be seeing up to 50 independent state-run healthcare programs. The beauty of diverse state healthcare programs is the following. While some states are undoubtedly going to get a good reputation for knowing how to manage healthcare, other states are going to be challenged by healthcare. But there is no law saying that the expert states cannot give the challenged states some good advice on how to run a healthcare program.

Also, where states with similar healthcare programs are concerned, corruption in one state’s program should be easier to spot when its healthcare books are compared with the books of other states.

What’s going on with the corrupt federal government is the following, IMO. State sovereignty-ignorant voters have been electing lawmakers to both the state legislatures and the federal senate who are as state sovereignty-impaired as the voters are. Consequently, these lawmakers have not been doing their jobs to protect state sovereignty by protecting citizens from illegal federal taxes and unconstitutional federal government interference in their lives as evidenced by illegal Obamacare. In other words, federal taxes laid in the name of healthcare should never have left a given state in the first place. (Did you hear that bankrupt California?)

Finally, the following link should help give people an idea how state sovereignty-ignorant voters have shot themselves in the foot with big, corrupt federal government as a consequence of the ill-conceived, anti-state sovereignty 16th and 17th Amendments.

They take your premiums and then use every device to try to cancel every sick, ailing or injured person on their books — I know. I was Director of Corporate Communications for Blue Cross of California when it went ‘public’ in 1993 and I saw how greed and profits turned that company into Wellpoint and then Anthem and its ’stakeholders’ into a selfish, money-hogging machine that did everything it could — with the help of get-rich-quick executives — to weed out the clients it least wanted. For all you blabbering idiots on this site — listen up! Without competition from a ‘public option,’ a place where the average Joe can turn up when his world of hurt turns upside down, premiums will only go UP and care and selection will go DOWN. Don’t you get it? It’s so simple. Open one store, they charge what they want. Open the same store next store, and you’ll see prices compete! It’s so simple. And it guarantees that you — and everyone — will have a place to go for health insurance if things go really bad in your life. Barbie, it’s amazing how many of you liberals spout great “ideas” that are so “honorable” but completely ignore what it will do to our country. Do you actually believe that a government run program will provide competition? It seems you are the one that needs to go read up on competition, not the rest of us.

You can’t compete with something that doesn’t have to worry about profit or be held accountable for anything. If Medicare were a real business, it would have gone bankrupt a long time ago, and now they’re going to try it on a much bigger scale. It is impossible for privatized companies to compete with the government, and the govt knows it.

There is nothing fair and competitive here. We will all be forced into it.

You think it’s an honorable idea, and I’ll agree with you on that, but the fact that you’re willing to ignore consequences like total lack of freedom (can’t choose your own coverage or procedures), major drop in quality of health care, eventual rationing of health care (yes it will happen), many of the best doctors will quit because they don’t make much money anymore, less doctors will go to school because they come out with huge debt that will no longer bring huge paychecks. Doctors will be forced to stay under “spending caps” so they will have to choose between giving a patient a test or procedure they need OR taking a penalty to their paycheck for going over the caps. Guess who’s going to win that battle when docs are already getting paid less? Not us.

Idealism without understanding the ramifications and just nodding and smiling as the government takes over is exactly what socialism is based on. Big promises while they hide what’s really going to happen until it’s too late.

If you ask the public “Do you think everyone should have Health Care?” with no strings attached, OF COURSE people will say, “well sure, that would be great”. That’s where your number comes from. Now try this:

If you ask the public “Do you think everyone should have Health Care, but the catch is: the government will take over health care which amounts to 18% of the U.S. Free Market, reduce your quality of care, raise your taxes so those other people can have it, raise your premiums, turn doctors off to medicine, and oh yeah, even though we’re raising all those prices and reducing spending on health care for elderly, it’s still not going to be paid for. Your kids will have the largest debt in the history of the country to deal with.

I’m pretty sure the answer would no longer be “well sure, that would be great”.

Ideals without caring about ramifications. Don’t worry, our kids will be able to pay for it!

By the way, Republicans are willing to do health care reforms, create nationwide competition for insurance companies (they can’t cross state lines as of now), and subsidies for those without health care, and lower doctors costs with Tort Reform, which will lower the cost of health care significantly for EVERYONE. Far left dems want nothing to do with those ideas. They want a govt. takeover and nothing less.

The United States is the only industrialized country in the world that does not have universal health care coverage for its citizens.

That fact should be an embarrassment and shame to us all. We spend nearly $2.5 trillion on care and we spend nearly 50 percent more of our gross national product (G.N.P.) on health care than the rest of the industrialized world. Yet we have over 46 million completely uninsured people and at least 10 million more seriously underinsured people.

You over here talking about race because a Black man’s picture is on this news thread.

So your argument is that the rest of the socialized countries have already done it, so we should to? We’ve had the highest standard of living in the world for decades because of our free market, and we have been the envy of those countries financially. So lets be more like them? What about the fact that their systems have been failing and they are starting to move away from them? There are plenty of reasons our health care spending is high that have nothing to do having with Universal Health Care or not. This will not fix our spending. It barely addresses our spending and you could argue this will make it worse…

Tort reform alone would cause a massive reduction in our national HC costs. Our Congress (Dems and even some Repubs) won’t allow it because the lawyer lobby is incredibly massive, and they won’t piss them off, at the expense of our entire nation.

Every liberal that at least has arguing points on this points out how we spend more on HC than every other country, but fails to point out that every other country has 10 to 100 times lower malpractice insurance costs for their doctors because they put caps on malpractice lawsuits! Use apples and apples at least.

No it’s not perfect, but how about we address our COSTS and not add to them. Govt. run HC will most certainly add to them. They can’t run something efficiently and they’ve proven it over and over again. Other countries are proving it as we speak and many are less corrupt than ours.
