CBS stepped in a big one for Obama — well done and we should change this — but not right now!

Ann Coulter (lawyer) made an excellent point about the 14th Amendment in an article this week. When the 14th Amendment was conceived, it specifically excluded aliens and foreign diplomat kids, etc., but of course, allowed for the naturalization of former slaves which was it's intent. This notion of the 14th Amendment was challenged and upheld two years later 1898(?) which stood until 1982.

It wasn't until 1982 that Justice Brennan wrote an opinion which snuck in the quip that alllowed the current anchor baby problem.

Having said that — this is NOT the time for Grahamnesty to cynically boost his conservative appeal in SC where he is a disaster but not up for election. All this globalist is really doing is stirring up Obama's Hispanic base for him from the right. This just plays into their racist narrative.
We don't need this, right now, they do.

Why didn't he do this two years ago? Or, just wait until after the election when he has the votes in congress? There's no purpose now. He's just playing a conservative foil for Obama.

Our Constitution has been shredded to pieces by Harvard Law School types of legal sleazes. They twist, spin, extort, and bisect every word to interpret it the way they want it to read.
Elk vs Wilkins 112 94 (1884) Spells it out quite clearly. Please look it up.
The supreme court decision of 1884, states very clearly that NOT Everyone born on U.S. soil is a legal citizen.

We don’t have to have new supreme court rulings every time we have a case……we have a history of cases already on the books. You should be a U.S. citizen if you are born here, but the parents should be LEGAL CITIZENS. How we could let this go for so long without making the necessary changes is just amazing! Of course they'll keep coming if they can get great medical care for FREE, as well as have your child become a U.S. citizen. All people must speak out from every ethnicity! There are legal Mexican Americans who despise this because they did it the legal way. The media needs to show the outrage of U.S. minorities in this country who are opposed to this, not just Americans of European decent!

The Chinese have 90 day tour packages now for pregnant women to come to the US to give birth – Canada had the same problem years ago and eliminated the anchor baby provision to solve the problem.

The "Elk" case involving American Indians decided. and has not been overturned. that unless the parents are 'subject to its jurisdiction of the US' their children are not anchor babies even if born on US soil…

" The correct interpretation of the 14th Amendment is that an illegal alien mother is subject to the jurisdiction of her native country, as is her baby.

Over a century ago, the Supreme Court correctly confirmed this restricted interpretation of citizenship in the so-called 'Slaughter-House cases' [83 US 36 (1873)] and in [112 US 94 (1884)]. The following shall be nationals and citizens of the United States at birth:
(a) a person born in the United States and subject to the jurisdiction thereof;
(b) a person born in the United States to a member of an Indian, Eskimo, Aleutian, or other aboriginal tribe.

American citizens must be wary of elected politicians voting to illegally extend our generous social benefits to illegal aliens and other criminals. "

Here is my suggestion and in this order:

1. Do away with the 'anchor' baby law!
2. Seal/secure the borders!
3. Document all illegals in our country!

Once that is done…we need to categorize the documented!

1. Felons in prison
2. All felons who were deported and then snuck back in to do crimes again!
3. All single males
4. All single females
5. All families

1. All felons..even those already in prison need to be deported first, without consideration, because with our borders secured we should not fear them coming back!

Once we deport all of the above groups, we more closely look at individual families to determine their status!

2. Did someone help you come here and what/who are they!
3. Have you been in any trouble since here?
4. Did you bring any children over the border with you?
5. How many children have been born in America?

7. What are they?
8. How long have you been here?
9. Where do you work? How long have you worked there?

Once questions like this have been answered it should enable the authorities to decide who goes and who can stay to consider their path to citizenry. But not until they pay any taxes owed, and/or penalties or fees owed to the government. Then they must get in line AFTER all others already on the list to enter in!

1) . All illegals who receive free medical services should have to pay for those services before becoming citizens. It cost $4,000+ to make that baby a citizen. If he wants to extend citizenship to his parents when he's 21, then he should have to pay the $4,000+ back.

You're half right. Diplomats don't automatically get citizenship for their kids. but in practice there's no enforcement provision, so a child of a diplomat could claim citizenship with just his US-issued birth certificate.____

I'm not sure how manyof them will claim welfare for life. They don't get to claim their citizenship until they're 21. If they want to come and get welfare then, they probably could. Simple. Take the issuance of birth certificates seriously for once. When a baby is born, create a birth certificate with unassailable documentation and then, to seal the deal, issue the birth certificate with a photograph of the newly born citizen. Then, have everyone carry a reduced certified copy of this proof wherever they go for the rest of their life. The certification combined with the photo will provide undeniable proof of one's citizenship.

A child born in Canada to two illegal alien parents would still be considered a Canadian citizen. " There's the exception for diplomats, very similar to the US. But a baby born in Canada is a Canadian citizen, same as the US.

Dear Urthmovr…the 14th amendment is just that…an amendment to the original! By virtue of being an amendment it is subject to UPDATE…and updated it needs to be!

The original amendment was done to ensure that the children of black slaves brought here and freed after the war…would be guaranteed citizenship to their new land and nothing more!

It has now been abused to the point of damaging our economy and our security and needs to be reviewed based on today's impact on society!

I believe our founding fathers would agree…because they were fair and equal…and would not appreciate the abuse that is happening today!

The above bold statement about "correct interpretation of the 14th amendment" needs to be boldy and clearly shouted from every rooftop. There is too much ambiguity floating around out there about this most serious issue.

On Fox TV the other day, I saw two fembots and the hairdo anchorwoman all agree when one childishly stated, "Well babies can't be ILLEGAL." Hat tip to the commenter who corrected me that 3/4ths of the states (38) are required to ratify the Constitution to revise the 14th Amendment.

To the other commenter, who thought we wouldn't need to ratify the Constitution if we'd just interpret the 14th Amendment correctly, by which is meant the end of automatic citizenship for the children of illegals, I say "Great, if the SCOTUS and COTUS would actually do it." But they won't and, in light of this, the only option left is amending the Constitution.

Since there's little chance of the Constitution being correctly interpreted the only, other route is amendment but I have already been corrected to understand that 3/4 of the states must ratify any amendment to the Constitution – requiring a steep 38 states – so I'm not sure this could even be accomplished. Pretty depressing, really.

By the way, I'm half Mexican and my house is 1.6 MILES from Mexico (measured to the middle of the International Bridge) My granfather was born in Mexico City, I speak functional Spanish, I've spent LOTS of time in Mexico, I have RELATIVES in Mexico and studied this issue IN DEPTH at the U. of Texas El Paso, which has a view of Mexico from amny places on campus. Mexico is a few hundred yaers from the south edge of UTEP. I have many Mexican national classmates and frankly I've forgotten MORE about the issue of of ILLEGAL border crossing and what the views and aims of these people than a vast majority of Americans.

We MUST SEAL our borders NOW. I DON'T CARE what Bush, Hoover, LBJ, Kennedy or whomever DID or DIDN'T DO.
