Federal Judge Rules ACORN Funding Ban Unconstitutional

Fox News: U.S. District Judge Nina Gerson said Wednesday that Congress acted unconstitutionally when it tried to stop federal funding of the troubled group last fall. In her ruling, she said it was "unmistakable that Congress determined ACORN's guilt before defunding it. ACORN alone was singled out for adverse treatment." She said there is a process when federal contractors can be suspended or cut off and that wasn't followed.

oh geez… Add this to the list of reminders come Fall. If a person can’t find out how or where to vote, forget where they stand on issues, they shouldn’t be voting!

Muggins   March 12th, 2010 - 12:26 am

Congress should not have been funding these leeches from the beginning.

wimperwimper   March 12th, 2010 - 12:32 am

I agree with Muggins – there should not have been funding for this totally corrupt bunch in the first place.

Sally   March 12th, 2010 - 12:36 am

This Organization should never have been funded. We need to throw out all of Congress and start over! People PLEASE do not forget all this stuff come the November election! We really need Term Limits for all the people in Washington. This is only one issue of many!

Vic   March 12th, 2010 - 12:37 am

Muggins/wimperwimper: no one deserves funding. Its a decision that should be made annually. This year, they’re out.

SeanB   March 12th, 2010 - 12:38 am

Gerson is one of the dumbest judges on the bench. And that says something.

please Muggins   March 12th, 2010 - 12:38 am

Don’t insult the leeches, they do what God intended them to do.

Sally   March 12th, 2010 - 12:39 am

VIC – Yes Acorn is funded this year. My understanding is ACORN only lost their funding for one month. They tried to defund them for longer but it did not work.

Mr. Sensitive   March 12th, 2010 - 12:43 am

What’s next? Cheap black Barbies? …oh wait.

JoeTulsa   March 12th, 2010 - 12:45 am

Let’s send it on up to the Supreme Court. Let’s see what they say!

DEF   March 12th, 2010 - 12:48 am

That “Federal Judge”, needs to be removed from the pedestal she sits upon!!!! Her political bias is shinning through!!! The Political correctness game is over, they just don’t have sense enough to know it yet!!! The Constitution was written in layman’s terms, it is simple to understand, this arrogant human is misinterpreting the law she swore “Under oath” to uphold!!! The only question is, is it deliberate?

DEF   March 12th, 2010 - 12:51 am

The defiance of handouts, is unconstitutional…… this So-Called Judge/judge needs to defend her ruling according to the Constitution.

thgirbla   March 12th, 2010 - 12:59 am

Note from Barry to Barry:

I takes care of’s my people !!!

Veritas   March 12th, 2010 - 1:20 am

Anyone who supports ACORN should not be involved in law or government!!! They have been proven to be corrupt. This judge must not have been able to judge on all the evidence. If she was, then she should be disbarred!

confused no longer   March 12th, 2010 - 2:01 am

Does that mean the signs go up again? Also isn’t it their charter that they are supposed to be non-partisan? doesn’t the preponderance of their activity’s that are clearly directed to the Dem side null and void their charter? Maybe we should just suspend the funds and have an inquiry, No not with Andy Stern and a bunch of union sympathizers chairing the committee.

confused no longer   March 12th, 2010 - 2:12 am

Oh yeh, by the way, get ready for this is just the beginning of activist left wing judges ruling from the bench. hey Congress, (all of you Bastards) hows it feel to get your nose rubbed in it. You have managed to neuter yourselves in 14 short months. Wait tell the Obama Czars start up with you, and the leftist judicial branch backs them up. The House of Congress is going to be like one of those Big Box Home Improvment chains that didn’t make it. Nicest looking flee markets on the planet, or maybe a wholesale food giant. Unbelievable

dave,nv   March 12th, 2010 - 2:15 am

Apparently obama already knew this, why else would there be 4 BILLION dollars in his budget for acorn?!

iconoclastKM   March 12th, 2010 - 2:26 am

This has GOT to go to a higher court.

Get out the Pitchforks and Torches people!

jdog   March 12th, 2010 - 2:39 am

This judge is full of it. Congress have the right to fund or defund for any reason. Is there a law out there that says the people MUST fund ACORN? I dont think so.

Billy   March 12th, 2010 - 2:54 am

God, look at all the stupid Republicans shitting on our Constitution. Yet again.

You’d probably have a hard time explaining anything truthful to these morons because they actually believe the things they hear about ACORN from Sean Hannity and Glenn Beck.

There’s even one moron up there who thinks Obama is giving ACORN four billion dollars. Can you imagine how stupid a person has to be to believe that Obama is giving ACORN four billion dollars? Think about it for a moment. It’s friggin’ mind boggling. But as common as coffee around here. The kind of thing you expect to hear from Michelle Bachman on the Sean Hannity show.

The ACORN cultists are almost as stupid as the Breitbart readers who still believe James O’Keefe entered those ACORN offices dressed as a pimp. Or the sharpies who feared that Saddam Hussein might spray anthrax on Little League fields.

The truth does not penetrate the euphoric comfort of ignorance. Never. Ever.

Tom   March 12th, 2010 - 5:01 am

This is proof that “judge shopping” is a lucrative practice…..on to the “Supremes”….

father_moray   March 12th, 2010 - 5:59 am

Get the names of the LimPOS who wrote the funding Bill…swarm them out of govt.
Hurry, better catch ACORN before they take the new 2-week OBAMAcare PHYSICIAN COURSE…and overnight are Certified OBAMAcare Doctors…with NEW NAMES …stealth Commies heading to their communist revolution somewhere else in America. just in time for your young daughters’ physical Exams. Cool, huh?

father_moray   March 12th, 2010 - 6:04 am

Beatch Papers over rule Whitehouse and Congress?…apparently the enemy is deeper than we thought…this judge attcks America. These ACORN PIGS need the Enema of Freedom. Anyone like The CFCR needs removal from the equation. And, of course, Obama knew she would refund what Congress wouldn’t… or would with a WINK…did…fracked us bigtime…payback…

Phear the GOOD NEWS, she’s OUT.

Julia   March 12th, 2010 - 6:36 am

Ha! Paybacks a bummer for you right wing thugs, huh? This is a great decision and finally a right decision! Seeing how by 2020 you pure white thugs will be the complete minority in this country, I see this playing out with many more leaders of color. No more dominance by the white rethigliklan any more! Should have won the civil war losers! Ha, ha, ha, ha, ha, ha, ha….!

wallyintouch   March 12th, 2010 - 7:19 am

Uh let’s see, this judge couldn’t be a Hussein supporter, could he? Some agency needs to check this a-holes’ financial situation for recent deposits. Wait, did the report say federal judge or fecal judge, oh well same difference if he _ucking BHO’s _ock.

More Craziness   March 12th, 2010 - 7:36 am

Excuse me? I didn’t know funding for ACORN was a ‘right?’ We can fund and defund anyone we want.

Grafted Devil   March 12th, 2010 - 7:55 am

I apologize to the other viewers, but I am SICK AND TIRED of these blacks hollering at the top of their lungs the same thing we would end up in front of a judge for.

I am SICK AND TIRED of these racists that accuse me of being one.

I am SICK AND TIRED of the arrogance of these people against Whites.

Im SICK of it…..and all of you here SHOULD be too.

Desiree   March 12th, 2010 - 8:55 am

What a hateful, bigoted racist this Julia is. What a psycho.

This judge needs to be investigated to see if her pockets are being lined by acorn.

Buhlz_I   March 12th, 2010 - 9:10 am

Quick!!!!…..Assembly both houses of congress….Prepare a State of the Union speech….Have the President come forth and denounce the judges decision.

This is really an awful court decision right Mr. President?

Jonathan   March 12th, 2010 - 9:19 am

So is there anything we can do to keep our money from going to this organization? I dont care if they were never found guilty of anything, thats not the point. They did nothing to DESERVE any fed funding.

Julia   March 12th, 2010 - 9:54 am

Hey Grafted Devil,

Ohhhhh we’re so scared! You worry us about as much as a pimple on our rear ends. So tough with your lame violent threats of blood in the streets. Bring it on loser! You and all that do will most undoubtedly perish in the process. Strength in numbers, and right now you DON’T, and wont have the numbers idiot!

Wanda   March 12th, 2010 - 10:05 am

Term limts would be great but rember cong. has to vote on that and I dont see them voting themselves out of a job!!!

Also just vote them out when they come up every time make your own term limts.

silversurfer   March 12th, 2010 - 10:10 am

Here in California, where I have resided since 1965, we are already forced to pay the highest sales tax in America, the highest state income tax in America, the highest state gasoline tax in America, the highest business tax west of the Mississippi, AND – we have “hidden taxes” such as one of the highest vehicle registration fees in our U.S. and some of the highest utility & electricity rates in our nation!

Yet, Judge Nina Gerson (and other Justices like her who undo budgetary reforms and cost-cutting legislative measures) want us to “pony-up” even more money in taxes and fees to pay for what our democratically elected legislators have removed from our budgets? And Judges like her do so by completely ignoring the will of the elected branches of our government?

Let’s cut her salary in half, as well as all those other Justices who seek to usurp the fiscal will of the voting public and our representatives. Let’s also cut all of their lifetime benefits in half – make them pay for all the endless entitlement & gov’t spending that they will not allow us to reform.

Personally, I simply allow those “progessives” who are gainfully employed, pay for their big government wish list while I use their very own socialist policies to my own advantage – just to continue to teach a lesson to those who, evidently, like to work and support the needs of others!

Spanky   March 12th, 2010 - 10:14 am

Obamunism is really hurting America.

Eileen for Freedom/Liberty   March 12th, 2010 - 10:22 am

2. WE “THE PEOPLE” ARE INVOLVED!
3. WE “THE PEOPLE” ARE GETTING OUT THE VOTE!

IMPEACHMENT OR THE ‘ORIGINAL’ RECORDS OF BIRTH…IT IS JUST A MATTER OF TIME…AND 2010 WILL BE THE TIME!

Nalora   March 12th, 2010 - 11:04 am

Yet another reason why the Federal Government should not be in charge of handing out charitable dollars to ANY organization.

Ha Ha   March 12th, 2010 - 11:24 am

I don’t get it.I guess some thought that some how going after Acorn would hurt Obama in some way.

Brooklyn prosecutors cleared ACORN of criminal wrongdoing after a four-month probe that began when undercover conservative activist , filmed workers were giving what appeared to be illegal advice on how to hide money.

Now that same conservative activist is charged with entering federal property under false pretenses with the intent of committing a felony, according to the United States Attorney’s Office for the Eastern District of Louisiana.
If convicted, that same conservative activist( you know who I mean BB) could face a sentences ranging from a fine to 10 years in prison.

The moral to this story is when you try to dig a ditch for others be careful that you don’t fall into it yourself.

Oh btw Eileen that birther stuff is old and no longer valid.
You need to keep up, there is a entire new conspiracy theory floating around about Obama that I haven’t seen mentioned on this forum. You guys need to keep up to date.

kmichaels   March 12th, 2010 - 11:43 am

Surely this is constitutional.

Certainly looks that way.

silversurfer   March 12th, 2010 - 1:51 pm

Additionally, here in California, we have 12% of our nation’s population, yet we have 34% of our nation’s welfare recipients.

This is because our California State Assembly & State Senate are almost 2/3rds “progressive” Democrats and they wouldn’t even vote to allow the Welfare Reforms implemented under then President Clinton in most of our U.S.A., to also be enacted here in California some 15 years ago.

So, even Bill Clinton, a Democrat, couldn’t get his version of Welfare Reform to be implemented here in the ‘California People’s Republic of Soviet Monica”! These are the ‘ACORN’ type of Democrats who continue to seek to simply buy votes by handing out entitlements from the government to as many people as they can get to vote for them. Only one problem – our California is just about broke, AND our United States won’t be far behind!

Dave in Oregon   March 12th, 2010 - 3:30 pm
