Etheridge is from a district that is 90% liberal democrats. His re-election is assured even though his actions were completely unacceptable. If he was on the way to a Congressional meeting or work, he could not have been arrested for his actions if it impeded his travel (see Article 1 section 6 sub-section 1 of the US Constitution.) He is a former NC State School Superintendent and should have been better behaved towards a student doing a project. The student was neatly dressed and is under no obligation to identify himself. Etheridge (along with most NC Democrats – see former Governor Mike Easley-do indeed believe they are above the law due to their majority political hold on the state of North Carolina.

A Google search of their News tab, under “congressman bob etheridge attacks student” returned NO results.

For the less educated commentators here that see nothing wrong with the Congressman’s response let me clarify it for you. It is perfectly legal for a citizen to use a video camera on a public sidewalk while recording a public servant. Same has the right to approach and ask questions of that public servant. The Congressman was within his rights when he asked for identification but the citizen’s also have the right not to answer. At that point the Congressman should have kept walking with a “No Comment” response. In any jurisdiction I know of in this country his grabbing,swatting and constraining the citizen was clearly an assault and possible battery.

It would be a slam-dunk in a fair forum and if charges were filed would be quickly and quietly settled out of court.

I was just thinking about this. The video appears to show the kids as being intimidated and a little scared. Obviously such a reaction was not expected and I would not have expected it either. I do not have to answer the question, but I am not permitted to to touch the person. Nor am I permitted to attempt to force them to tell me who they are. In Pennsylvania, the only time that an officer has the right to compel a citizen to provide his or her name is if the officer arrested the individual. Or if the officer is conducting and official investigation of a crime and must obtain the peron’s name in order to further the investigation.
As a matter of fact, if a police officer were to conduct himself such as the congressman did, it would be a violation of the citizens’ Constitutional rights, therefore becoming the jurisdiction of the FBI who would investigate the police officer for civil rights violations.

North Carolina district 2 leans Republican by 2% points. (Source- Cook political report.) This district went to Obama by only 52% to 47% in 2008. This seat is very winnable in November. Elected representatives do not seem to understand that they are public servants. This behavior is despicable. He should be arrested for assault and then he should resign. He had the choice to say “no comment,” or, he could have told the young men he was in a hurry and to make an appointment to interview him at a better time, or he could have just ignored them. We need to do several things. 1. Cut the pay of elected representatives, public servants should not make more than the average wage of their constituents, 2. Well, that’s a tough question Dave. Generally the victim must pursue the charges, but I have seen instances where victim’s have initially pressed charges then later decided not to show up for court at which time the charges are usually dropped. But I have seen instances where the district attorney subpoenad the uncooperative victim (generally involves domestic violence and/or sexual assault) and forced the victim to testify. It can be done, but it doesn’t happen very often.
Regardless, the victim does not need to pursue charges for the congress to open a congressional investigation into the incident.
Or possibly the FBI to investigate the incident.

Personally, I would have responded to the invasion of my privacy about the same way her did and demanded an explanation and been none too happy when none was forthcoming.

Let’s run through the scenario for the idiots who say “He has a right to know their names?” and “Why wouldn’t they say who there were?”

First, as almost everyone has pointed out…you have no right to know anyone’s name. Nobody has a right to know your name. But since they do, I want all of you who say that the congress man has a right to know their name to post your name (full name) and the town in which you live here. Don’t worry, I won’t look up where you live or anything… (what, don’t you trust me?)

And that leads to my next point…

I sure as hell wouldn’t give some violent Congressman who has the power to sick the IRS or SEIU Union thugs on me my name. I’d be afraid to give him any information with which he could identify me. They kids were smart not to list their college as well as it is likely funded by the government and the Congressman could use that funding as a lever to coerce the university into finding a reason to expel the students (or alter their grades).

The kids were fully within their rights and were very intelligent in not giving any way to identify themselves. What you should ask is why the Congressman wanted to know who they were? Does it really matter who? All they did was ask a question about his support for the president, which is definitely not a personal question.

The congressman asked him which school he is from and the “student” could not answer. He just turn around the “student” so the “student’s” face could be shown in the video.

But in his defense, those two college kids were starting to heckle him with videotaped questions without identifying themselves first (it’s usually polite to introduce yourself before you start asking questions and immediately waving a camera in his face). Second, why didn’t the kid tell him who he is with? Typically when you try to talk to someone on tape you tell them who you are and what you are looking for. My guess is that he is a GOP flunky that is a mere “student” at the Karl Rove University of Dirty Tricks.

No, that’s the very definition of a BATTERY and this old man needs to be prosecuted for it. It may be politte but it’s not REQUIRED to identify yourself. No, congressman baggyeyes doesn’t have a RIGHT to know who they are. He could have just walked on by without responding. I’m a member of the media…and I have never ever seen anything liek this in all my years behind the camera. But I can telly ou one thing–if a congressman had grabbed me like that, his problem would not have been my name, it would have been getting the 7 pound Anton/Bauer battery back out of his skull.

This is assault and battery, plain and simple. With him failing to let go of the students hands after several requests one may even venture into what some states consider as false imprisonment. If someone grabs you, and refuses to let go after several requests, and had no right to touch you in the first place, not to mention he is a public employee ( lightly defined), most people would demand action. Whoa good thing this guy is not a conservative or it would have been plastered all over the media, much like the much to do about nothing alleged racial spitting incident with no proof whatsoever.
