Regulatory Czar: Right to Bear Arms Arguments Stem From ‘Fears’ Not ‘Civic-Centered Founding Debates’

October 23, 2007: "My tentative suggestion is that the individual right to have guns as it's being conceptualized now is best taken as a contemporary creation and a reflection of current fears, not a reading of civic-centered founding debates. Modern gun owners who are invoking the Second Amendment on the basis of a principle they favor are perfectionists," now-Regulatory czar Cass Sunstein lectured.

Sad to say but the anti-second amendment rhetoric was expected out of one if not all of these intellectual buffoons (czars) the president surrounds himself; however, the complete shocker was the line:

“Not so different from older people who tried to, unsuccessfully I’m pleased to say, get the equal protection clause read to strike down mandatory retirement law.”

While I’m not sure on which specific equal protection clause and mandatory retirement age lawsuit he was citing (of the two easily found one deals with age limits on judges [not politicians oddly enough]), the jaw-dropping part was when he said “unsuccessfully I’m pleased to say” in reference that he’s happy with mandatory retirement ages being applied. Outside of a few exceptions where high physical demand is necessary for job performance I can’t understand why anybody who’s lived half their life would be for forced retirement. Ironically, and hypocritically speaking, I’d be happy with his comment about mandatory retirement if it meant age limits (either physical age or age as in terms served) for all politicians from local, state and federal.

Get ready, here he comes and he wants your firearms that you don’t need, shouldn’t have, and you just keep because you are a racist “clinging to your guns and religion”.

You can’t subjugate an armed people.

An interesting lesson in history.

In 1929, the Soviet Union established gun control. From 1929 to 1953, about 20 million dissidents, unable to defend themselves, were rounded up and exterminated.
——————————

In 1911, Turkey established gun control. From 1915 to 1917, 1.5 million Armenians, unable to defend themselves, were rounded up and exterminated.
—————————–

Germany established gun control in 1938 and from 1939 to 1945, a total of 13 million Jews and others who were unable to defend themselves were rounded up and exterminated.
—————————–

China established gun control in 1935. From 1948 to 1952, 20 million political dissidents, unable to defend themselves, were rounded up and exterminated.
——————————

Guatemala established gun control in 1964. From 1964 to 1981, 100,000 Mayan Indians, unable to defen d themselves, were rounded up and exterminated.
—————————–

Uganda established gun control in 1970. From 1971 to 1979, 300,000 Christians, unable to defend themselves, were rounded up and exterminated.
——————————

Cambodia established gun control in 1956. From 1975 to 1977, one million ‘educated’ people, unable to defend themselves, were rounded up and exterminated

Defenseless people rounded up and exterminated in the 20th Century because of gun control: 56 million.

I saw this and one other video talking about taking away 2nd amendment and then in the second video he said that he wanted to take sports hunting away because “I just time.” In that second video he explains that animals should have the right to sue. These videos are linked on http://www.americanparchment.com/library/obamasczars.html. Sadly the other video you have to fast forward to 46 minutes into it (it is really easy and quick) because it shows a meeting of other legal minds (radicals) of animal’s rights. So I fast forwarded to his speech and it is quite interesting. The good thing about this is that there is no cutting of his speech, he speaks his mind and there is nothing any conservative is trying to hide, you can hear his whole speech.

Biblically!

THOUSANDS of 1st century Christians were crucified by Caesar. Not only crucified, but lit afire to light the streets of Rome.

What did God tell 1st century Christians to do about this tyrant?

1. Make war on this tyrant?
2. Become ruler in place of this tyrant?
3. HONOUR that tyrant?

1 Peter 2:17 Honour the king!

Christians ARE to be a peculiar people of a peculiar God!

Isaiah 55:8 For my thoughts are not your thoughts, neither are your ways my ways, saith the LORD.
Titus 2:14 Who gave himself for us, that he might redeem us from all iniquity, and purify unto himself a peculiar people, zealous of good works.
1Peter 2:9 But ye are a chosen generation, a royal priesthood, an holy nation, a peculiar people

Don’t tread on us Mr. Sunstein.

This administration is trying to destroy the 1st Amendment, now the campaign has begun to eliminate that pesky 2nd Amendment that stands in the way of Obama’s Communist Dictatorship.

How long before he declares himself President for Life? Next year, or next month?

Yeah it’s almost like the rest of the country doesn’t trust you freaks from Harvard huh? bahahhahaha

Fremont   September 8th, 2009 - 3:26 pm

How did he get a job teaching?

The 2ND Amendment reads: A well regulated militia, being necessary to the security of a free State, the right of the people to keep and bear arms, shall not be infringed.

First of all, we must remember that the Bill Of Rights, the first ten amendments to the United States Constitution, protects the rights of all individual citizens of the United States and its territories. And puts limits on the powers of the Federal Government and any other government in these United States. The 2nd Amendment DOES NOT give the rights to the Militia to keep and bear arms. It only states that a militia is necessary to the security of a free state. It clearly states RIGHT OF THE PEOPLE to KEEP AND BEAR ARMS, SHALL NOT BE INFRINGED.

A militia is a group of citizens coming together to provide defense against an enemy or its own government that has gotten out of hand. It is not the National Guard or the Army Reserve.

The 2nd Amendment of course, also covers the ammunition and other items the citizen needs to use the arms. For without these items the citizen can not use his arms and therefore his rights would be infringed.

SHALL NOT BE INFRINGED means to me any type of law that requires me to register, get a permit, forbids any type of arm, tells me that I can not carry an arm on any property (other then private property that the owner has asked me not to carry an arm on, etc.) are infringements and are unconstitutional. It seems to me that government property belongs to the citizens and its seems to me the government has no right to tell anyone they can not protect themselves by carrying arms on themselves while on government property. Note: The preamble to US Constitution states: We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America. In other words the government was formed by the people for the people – not for the government. The Bill of Rights are Rights that we the people gave ourselves. One reason for the 2nd Amendment was so if, our government took these rights from us, we could take them back the same way our forefathers did. If other ways failed to do so.

It is my belief that the 2nd Amendment is the ONLY legal law concerning our RIGHTS as individuals to keep and bear arms in these United States. NO government federal, state, country, city, NO treaty with any other government, etc. has any right to make any law concerning arms. All citizens have the NATURAL right to protect themselves, family and property from all transgressors.

Whatwhatwhat   September 8th, 2009 - 3:29 pm

Prof. Sunstein is absolutely correct. The reich-wing has reinterpreted the 2nd Amendment to be something to other than what it was written to do. What’s next? Are they going to assert the right to own a nuclear weapon or a tank?

The right-wing is so uneducated and so out of touch that they think they can just yell Founding Fathers and Ronald Reagan and act like they know what they are talking about. They know little to nothing about what the Founders actually wrote or stood for. I have little to say in agreement with the policies of Ronald Reagan but I know the man never questioned the patriotism of his political opponents.

A government that does not fear it’s citizenry is a government that will enslave it’s people. The right bear arms is the primary factor in insuring the cretin’s first amendment rights to spew his venom. Good to see the administration is keeping the public stirred up over what we consider to be our sacred cows. I hope they keep up the irritation right up to the 2010 elections. That is what it takes to un-elect the 33% of congress who are up for re-election every 2 years. Hopefully both parties will suffer a big turnover that will serve as a wake up call that their boss is not happy with their performance.

The loopey left just continues to fail. They fail to realize our Founding Fathers were revolutionaries. They fail to understand the revolutionaries had experience in being oppressed by a powerful, dominating government.

Our Founding Fathers realized people need to be able to defend themselves – not so much from other citizens, rather, to be able to defend themselves from their own government..

DDuke provided a summary of government oppression and murder.

How can we trust this president when he states he doesn’t want our guns, then he czars a nutcase like this guy? Lack of trust in one’s government is an excellent reason to have guns and the necessary ammo to defend one’s right to liberty.

The founding fathers were clear on the subject that the government should fear the people and not the other way around. Obviously, if the government were the only force with guns and citizens were refused the right to have guns then that would go against simple common sense and the writings of the founding fathers. Legally, the constitution is also clear that regardless of the pretext, the right to bear arms will not be prohibited. It does not matter why you think what you think is the reasoning, the end result is that the right to bear arms will not be prohibited. On another point, it would be pure suicide and pure stupidity to willingly give up your guns with the idea that the government is going to be your lifelong friend and will never be corrupt and never let some socialist like Obama take control.

To this Idiot in Chicago,

Benjamin Franklin: Those who would give up essential liberty to purchase a little temporary safety, deserve neither liberty nor safety.” (Nov 11 1755, from the Pennsylvania Assembly’s reply to
the Governor of Pennsylvania.)

Thomas Jefferson: “Laws that forbid the carrying of arms…disarm only those who are neither inclined or determined to commit crimes. Such laws only make things worse for the assaulted and better for the assassins; they serve to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man.” (1764 Letter and speech from T. Jefferson quoting with approval an essay by Cesare Beccari)

John Adams: “Arms in the hands of citizens may be used at individual discretion in private self defense.” (A defense of the Constitution of the US)

George Washington: “Firearms stand next in importance to the Constitution itself. They are the people’s liberty teeth (and) keystone… the rifle and the pistol are equally indispensable… more than 99% of them [guns] by their silence indicate that they are in safe and sane hands. The very atmosphere of firearms everywhere restrains evil interference [crime]. When firearms go, all goes, we need them every hour.” (Address to 1st session of Congress)

George Mason: “To disarm the people is the most effectual way to enslave them.” (3 Elliot, Debates at 380)

Noah Webster: “Before a standing army can rule, the people must be disarmed, as they are in almost every country in Europe.” (1787, Pamphlets on the Constitution of the US)

George Washington: “A free people ought to be armed.” (Jan 14 1790, Boston Independent
Chronicle.)

Thomas Jefferson: “No free man shall ever be debarred the use of arms.” (T. Jefferson papers, 334, C.J. Boyd, Ed. 1950)

James Madison: “Americans have the right and advantage of being armed, unlike the people of other countries, whose people are afraid to trust them with arms.” (Federalist Paper #46)

WHAT THE FOUNDING FATHERS MEANT BY THE “MILITIA”

George Mason: “I ask you sir, who are the militia? They consist now of the whole people.” (Elliott, Debates, 425-426)

Richard Henry Lee: “A militia, when properly formed, are in fact the people themselves…and include all men capable of bearing arms.” (Additional letters from the Federal Farmer, at 169, 1788)

James Madison: “A WELL REGULATED militia, composed of the people, trained to arms, is the
best and most natural defense of a free country.” (1st Annals of Congress, at 434, June 8th 1789, emphasis added.

IMPORTANT NOTE: Back in the 18th century, a “regular” army meant an army that had
standard military equipment. So a “well regulated” army was simply one that was “well equipped.” It does NOT refer to a professional army. The 17th century folks used the term “STANDING Army” to describe a professional army. THEREFORE, “a well regulated militia” only means a well equipped militia. It does not imply the modern meaning of “regulated,” which means controlled or administered by some superior entity. Federal control over the militia comes from other parts of the Constitution, but not from the second amendment. (my personal opinion)

Patrick Henry: “The people have a right to keep and bear arms.” (Elliott, Debates at 185)

Alexander Hamilton: “…that standing army can never be formidable (threatening) to the liberties of the people, while there is a large body of citizens, little if at all inferior to them in the use of arms.”
(Federalist Paper #29)

“Little more can be aimed at with respect to the people at large than to have them properly armed and equipped.” (Id) {responding to the claim that the militia itself could threaten liberty}” There is something so far-fetched, and so extravagant in the idea of danger of liberty from the militia that one is at a loss whether to treat it with gravity or raillery (mockery). (Id)

MODERN LEADERS THOUGHTS ON GUN CONTROL:

Adolf Hitler: “This year will go down in history. For the first time, a civilized nation has full gun registration. Our streets will be safer, our police more efficient, and the world will follow our lead.”
(Chancelor’s Speech, 1935)

Charles Shumer: (US Congress, has sworn an oath to defend the US Constitution) “All we ask for is registration, just like we do for cars.” (Press conference, 1993, exact date being sought)

Adof Hitler: “The most foolish mistake we could make would be to allow the subject peoples to possess arms. So let’s not have any talk about native militias.” (Hitler’s Secret Conversations, 1941-44, Farrar, Strauss and Young, 1953)

Mao Tse Tung: “All political power comes from the barrel of a gun. The communist party must command all the guns, that way, no guns can ever be used to command the party.” (Problems of War and Strategy, Nov 6 1938, published in “Selected Works of Mao Zedong,” 1965)

Diane Feinstein: “US Senator, If I could have banned them all- ‘Mr. and Mrs. America turn in your guns’ -I would have!” (Statement on TV program 69 Minutes, Feb 5 1995)

Bill Clinton: (US President, has sworn an oath to defend the US Constitution, (not to violate it, criticize it, and belittle it)) “When we got organized as a country, [and] wrote a fairly radical Constitution, with a radical Bill of Rights, giving radical amounts of freedom to Americans, it was assumed that Americans who had that freedom would use it responsibly…When personal freedom is being abused, you have to move to limit it.” (April 19 1994, on MTV)

FOUNDING FATHERS INTENT BEHIND THE CONSTITUTION:

Samual Adams: “The Constitution shall never be construed to prevent the people of the United States who are peaceable citizens from keeping their own arms.” (Convention of the Commonwealth of Mass., 86-87, date still being sought)

Noah Webster: “Good intentions will always be pleaded for every assumption of authority…the Constitution was made to guard against the dangers of good intentions. There are men in all ages who mean to govern well, but they mean to govern. They promise to be good masters, but they mean to be masters.” (Source still being sought)

Thomas Jefferson: “On every occasion…[of Constitutional interpretation] let us carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying [to force] what meaning may be squeezed out of the text, or invented against it, [instead let us] conform to the probable one in which it was passed.” (June 12 1823, Letter to William Johnson)

I along with many other Americans think guns should be banned. Look at the inner cities and the horrible crimes committed. Look at the black on black crimes. Look at the domestic violence on women. Robberies and on and on. Giving up your guns is taking up your life. I feel guns should be banned and asap.

Judge orders trial on eligibility issue
Arguments planned Jan. 11 for challenge to Obama

kmichaels   September 8th, 2009 - 6:42 pm

Gina, nuts should be banned, and guns should be purchased en masse, to prevent all that violence that you say you are aware of from happening in our own personal homes, where we are not violent by nature, where we are not killing our own women and our own community. But Gina, since you are free to be a nut in America, more power to you, not only should you not protect yourself but you should post a sign on your front lawn declaring that there is no gun in your house, nor knives and that you will roll over like a whipped pup while they beat you and your kids in front of you. That would be the wise thing to do.

christian reyes   September 8th, 2009 - 6:43 pm

Just try to take my guns…they protect me from criminals and tyrants…which one are you sunnyboy

kmichaels   September 8th, 2009 - 6:44 pm

Craig Allen, since you are anxious to die for your beliefs and prove that you are the only real Christian that ever lived, I suggest you go into Palestine and shout very loudly, like hmmm, John the Baptist. Declare to the palestinians there that the only true religion is that of Christ, and then when they stone you, mob you, beat you, shoot you, stab you, and cut your head off, we will all remember good old brilliant what’s his name, for ever more. Amen.

Panic in D.C.?
Justice urges birth suit tossed
Late motion filed by feds as case ready for hearing

© 2009 WorldNetDaily

Is this the footprint of baby Barack Obama?

The U.S. Justice Department is urging a federal judge in California to dismiss a lawsuit challenging the constitutional eligibility of Barack Obama to hold the office of president.

The highly anticipated hearing tomorrow morning before Judge David Carter features attorney Orly Taitz and numerous plaintiffs, as well as a document that one person has sworn is the original birth certificate of Obama from Kenya – not Hawaii, where the administration maintains Obama was born.

The suit alleges Obama is actually a citizen of Indonesia and “possibly still citizen of Kenya, usurping the position of the president of the United States of America and the commander-in-chief.”

Out of my cold dead hand.

A RIGHT is not having to ask permission.

Fear is something liberals eat and drink for breakfast. They have no trust. They assume everyone else’s hearts are as dark as theirs.

H2K   September 8th, 2009 - 8:48 pm

Yes, I fear my government. That’s why we need to bear arms. That was the reason the founding fathers wanted an armed citizenry so that the government would-not/could-not intimidate us.
By the way, what kind of a person speaks like Sunstein? Must be czar-speak.

Chew on this you Statist/Commie POS!!!

The Declaration of Independence is codified law of the United States of America.

No ifs, no ands, no buts. Period.

To deny this is to willfully surrender your own personal dominion & birthright, thus becoming pliant State chattel.

The fundamental concept of one meekly, dutifully abdicating to the Leviathan of State, one’s absolute right of separation from said State, is wholly reviled & the absolute antithesis for the Constitutionalist of Original Intent.

Remarkably, the Constitutionalist is now considered a mortal threat by the DHS due to his proper & unwavering reservation for the foundational precepts of God’s Natural Law.

These timeless rights were guaranteed long before the Heavenly-inspired inscribing of the Founding Documents & thus have existed from the very moment God decided to bequeath them to all mankind.

These rights have no shelf-life nor any factual redress from the contrived result of a simple majority foolishly clinging to the “light and transient cause” of perverted societal change, being hypnotically swayed only by the simple solicitation of esoterically twisted logic.

Found cradled in the supreme prose of the Declaration of Independence, is the inherit, God-given rights of all Men to justly throw off & smash the harsh yoke of a tyrannical State; a State which is now clearly in breach of the civil contract it swore to uphold & is duty-bound to jealously protect.

At it’s very core, there is a paramount Failure of State. The scope of failure is undeniable, unsustainable & alas, nearly unsalvageable.

This Government has become openly ‘destructive’ to the proper ends of wise determination.

The Body of State has clearly forfeited the unalienable consent of the governed & recklessly abdicated the temporal privilege of obedient & serviceable governance.

Those readers of a ‘litigious’ nature, should pay heed to the overwhelming impact contained within the Declaration’s cataclysmic opening words.

Since God’s initial Earthly Paradise was lost by Adam’s vain ignorance, every common Man’s unique individuality has been cursed at the hands of countless despots.

Then, for the 1st time in human history, The Declaration of Independence successfully rescinded this natural state of Man’s wanton wickedness over his fellow Man. Thus, over the next 200 short years, the Declaration & the Constitution have been definitively proven to be as close as possible to God’s absolute truth for the proper governance of this most imperfect creature.

The Declaration’s non-negotiable recognition of where rights are truly derived, is why secularists, statists & tyrants in general, regularly play-down & even outright ignore the Declaration as a non-binding or antiquated document of minor import.

Nothing can be further from the truth.

Historically speaking, the Declaration is young, yet it’s age is inconsequential. The truths revealed therein are nearly eternal. The words were written to withstand the onslaught of sand.

Following the opening statements when the Founder’s rapidly commandeer their true Liberty, the list of incisive indictments of the State’s abuses & usurpation’s are carefully recorded & lay bare obvious witness to the entire oppressed lot. These are succinct & effective descriptions of absolute tyranny & thus command timeless application & unprecedented parallel across the generational divide. In these glaring truths of self evidence, the Declaration remains an unbreakable mirror of revelation for recalcitrant governments everywhere, vividly confessing every wart, callus & pustule that attempts to shun the light.

No freedom is ever free, therefore, liberty must be physically purchased in the Patriot’s & Tyrant’s blood. Within the 2nd Amendment is garrisoned the requisite weapons for the initial demand & vigilant preservation of the Free State.

Overtime, the operational fulcrum where rests the commanding weight of We The People, shall remain the 2nd Amendment. This will never change due to Man’s insidious duplicity, which lies untamed, just beneath his shallow smile. Thus, the 2nd Amendment is an irrevocable guarantee that duly ensures the citizenry’s unfettered access to a perpetual bulwark that is the necessary means to properly execute their duty-bound eternal defense of the Free State.

Once the physical being inhabits the well of self-determination, civilization then allows for wit, wisdom & persuasion to be the order of the day & thus maintain the political balance. Man’s better angels are then set free to roam & improve the lot of others.

However, the State has a severe predisposition towards the naked display of self-servile hedonism, resulting in it’s continual mis-comprehension of the actual hierarchy.

The consensually governed swiftly becomes the unrighteously ruled.

Initially, out of a feigned appearance of restraint, rights are only cleverly dismissed. Soon after, rights simply become objects of jest & sport as the fiefdoms of old once again cruelly dominate the bitter landscape.

No retreat remains. Our smite simply becomes involuntary action.

I bow to no man & never will.

By hook or by crook, this creed shall persist.

The State simply can stake no claim upon my eternal soul.

RightWingExtremist   September 9th, 2009 - 6:56 am

The Second Amendment was put into place in case the government ignored the rest of them. So far, they’re doing a bang-up job of just that. As a career Army veteran, I took an oath to defend the United States from all enemies, foreign AND domestic. I can see that I will continue to honor that oath as I defend myself and my rights from the DOMESTIC enemies that are now trying to dismantle the Constitution and the rights that document guarantees to each and every American citizen.

Six Republican senators voted for Sunstein. They are:
Sen.Robert Bennett Utah, Sen.Susan Collins Maine, Sen. Judd Gregg N.H., Sen.Orrin Hatch Utah, Sen.Richard Lugar Ind, Sen.Olympia Snowe Maine

I would suggest contacting and letting them know what you think and I suggest you send a donation to their opponents.

trevor   September 17th, 2009 - 8:23 pm

I do everything i can to prove we should be able to own guns. I believe that we should be able to own guns and think that it is pathetic, thinking that they can restrict, take away, and make us put locks on our guns. I just want to ask Mr Sunstein something, if someone walked into his house, would he be okay with not having a gun to protect him? By the way, just a little heads up to him, taking guns away from the good and sensible people wont decrease gun crime rates. They will either use the guns they already have or get them on the black market. Your actually killing people because they cant defend themselves.Think about it……
