People, can we please focus on the issue at hand. There is a school rule that says no beads. His family died five years ago, but he only started wearing the beads 2 months ago. If the beads are for him to remember his uncle and brother, and the school is fine with him wearing them under his shirt, then why does he need to wear them on top of his shirt before the rule can be changed?

The school has a rule against beads. He’s got plenty of options… tuck them in, wear a crucifix without the beads, find another way to honor family members. And he can wear as many rosaries as he’d like before and after school.
The school should not make an exception for him. Lots of schools have this type of policy, not just about beads, but about rosaries in particular. the wearing of rosaries as a necklace has become a symbol for some Mexican gangs (and Madonna in the 80’s). Rosaries are prayer beads, not jewelry! I wonder how many people commenting on this child’s oppresion as a Christian would come to the defense of a Mexican teen (covered in tattoos and wearing “gangsta” clothing) in a Los Angeles public school with a similar policy.

The rules are clearly stated. This is not a religious issue and making it out as such is just one more absurd right wing conspiracy about “lost rights”.
The rule is “no beads” on the outside of a shirt. He could wear them on the inside but his mom, who evidently doesn’t want to teach her son to play by the rules, wants to turn this into another soapbox moment of the big bad government telling people what to do.

It was to protect the church FROM THE STATE. If the government established a state religion, the government would then dictate the terms of said religion. Wrong again! Read some of Jefferson’s writings sometime. NOWHERE in the founding documents do you see the phrase “Separation of Church and State”…period. Jefferson referred to such in a single letter to an obscure Baptist congregation, but he was talking about avoiding a STATE RELIGION, which was the norm in Europe at the time. NOT the same thing as kicking God out of government affairs at all.

Thank you all for standing up for this Catholic symbol, but the rosary is not meant to be worn as jewelry. It is to be used to pray to Our Lady. However, this young man was told to take it off because it was a Catholic symbol not because it was disrespectful to the Blessed Mother. How very sad that such a symbol of love and peace may be used as a gang symbol. For those you pray the rosary, offer one up in faith that those who have no idea what these beautiful beads mean will come to know her.

The nuns in my Catholic school forbid us to wear rosaries. They taught us that it was disrespectful to use an article meant for prayer as jewelry. They would be aghast at gang bangers who wear rosaries as bling.
If devout Catholics don’t wear rosaries, then the school is not limiting religious self-expression by banning the wearing of rosaries. The school is doing the right thing to track and deter gang insignia inside the school. Would you object if the school banned certain color combinations to protect your child’s safety?
A caring adult should help young Raymond find another way to honor his uncle and brother. Even better, if he doesn’t know how to pray the rosary, someone could teach him to use the rosary to pray for his family and for his school.
I’ve read statements like, he can just “tuck” them in and all is fine, but that is “censure.” The point is, he shouldn’t have to hide them away. The question here is if the school has the legal right to ask him to tuck them away, or if he can wear them openly. Given the Tinker v Des Moines Supreme court decision in support of students and their rights to express “silent speech”, it’s not likely the school can or will win this one. We should also consider that the student has been wearing the rosary “openly” since the beginning of the school year. Does it not raise any eyebrows that the school just now decided to enforce the rules that they have made?
Although I see it as a common view, the position that “rules are rules” is not a valid argument. Rules are not permitted to violate the constitutional rights of an individual, no matter how the school may choose to see things. You can claim that the student was being disobedient, but when policies and rules are unfair (and potentially illegal), and they work against us, shouldn’t we practice civil disobedience? In addition, I’ve read the demand letter from the ACLJ. It was respectful and cited the court cases. The school has chosen to not take action, so the courts have to.
I read up on the Chalifoux v. New Caney case – I bothered to take the time and read the entire thing (too much time on my hands perhaps) and this gives strong precedence in favor of the student. (And the findings also address how the rosary is worn, so it doesn’t matter if the student is wearing them improperly or not, based on the findings of the court, it was irrelevant.) Frankly, I think it’s appropriate to challenge and stand up for our rights. It doesn’t matter if people feel the child is being “defiant” or “insubordinate”, he has the legal right to excercise his first amendment rights at the school no matter what anyone else may feel, and the Tinker decision clearly addresses it.
Schools should teach us our rights and responsibilities as part of our education system, not tread upon them. Besides, it puts the schools in a position to re-think how they write a dress code, and it holds them to a level of accountability they seem to think they can ignore for the moment. Remember, this is not a private school, it recieves federal subsiides, so they must play by the rules.
