They should come out of this with some money. What a stupid way to die. I blame those idiots who wanted a bargain. Someone should have helped him up. The American people are starting to suc*. Just look at the last election. It’s whatever you can get for nothing. Are country is becoming on big sh** sandwich. Take your bite.

The responsible parties are the unbelievably self-centered people who killed this young man through their greed. Wal-Mart was offering things for sale, they had no responsibility for the actions of the people who behaved like animals.

Walmart has an obligation to protect its employees. They should have known better than to allow a stampede. Something similar happened ten years ago with the fur babies.

They better settle with the family; otherwise, they will wound up paying millions more if it goes to a jury.

I think WalMart should fight it til the end. And base their argument on the fact he was too stupid to get out of the way. They should counter sue his family.

Buyer beware   December 3rd, 2008 - 5:15 pm

Walmart is legally responsible for it’s employee regardless what anyone thinks about the incident. They will pay the family sooner or later.
They are also responsible for damage to your car while on their property by shopping baskets regardless how they protest they are not. Both situations have plenty of legal precedent.

Wal-Mart,

Settle with the family. I’d say about one hundred bucks will suffice. Then close the store and get out of that rat infested ghetto.

And to all who think that’s mean spirited…

Go and live in that lovely neighborhood.

WalMart is 100% liable for the safety of its employees and the attorney representing the plantiff should include in the settlement an acknowledgement of guilt.

Walmart should protect it’s employees from the customers, the manager should have known the customers were going to stampede the store, completely out of control with greed – perhaps they should arm all their employees with AK47’s on full automatic and supply them with several thousand rounds of ammo each – that should protect the employees from the customers.

Or perhaps have the employees work in bullet proof glass cubicles.

Ah, then again just pay the employees and have them stay home.

Or – perhaps the police should review the security cameras and arrest the people that trampled the guy and hopefully the Judge will give each one life – I personally believe it is more constructive to punish the guilty party than the innocent.

I don’t believe a 6-foot-5, 270-pound man died from getting pushed over onto the floor. I would believe a pre-existing health condition that contributed to his death. There is more to this story than we are hearing at this time.

blame walmart there we go. I liked the comment from the other worker that said they were like savages.they should have locked down the store an arreseted everyone. And the attourney for the family his final comment was The family disposed the body . that was very cold. the shoppers were at fault . go aftyer them

You should not be able to hold Wal-Mart legally responsible for the actions of a crazed crowd.

With all due respects to his family, we all share your sense of loss, but you are not entitled to enrich yourselves unjustifiably. You’re going after Wal-Mart because of insurance and deep-pockets.

Perhaps your relative should have gotten out of the way of the wave of crazy people who knocked down the doors.

Should they be prosecuted? No, because it was not an intentional act. Manslaughter, perhaps, but something tells me that there is more to this story than meets the eye.

You are entitled to receive workmen’s compensation benefits and nothing more. Sorry, we all take chances in this life and your relative was a victim not only of an unruly crowd but uncaring people who should have come to his aid.

John   December 3rd, 2008 - 8:58 pm

This poor guy had no idea the mess that was coming through that door…Why wouldn’t he?
I wouldn’t be caught dead in a crowd of Walmart shoppers….It always like a herd of cattle in thise stores…from trough to trough…fat slovenly heifers consuming everything that doesn’t consume them first….

The reflection won’t light on most Americans until….excuses are made and all those primates are allowed to walk and Walmart is forced to pay huge fines and fees….Then we will know that America has gone to the hogs….filthy, dirty, stupid asshole hogs of every nationality and ethnic persuasion…
f the herd of sub human primates…

To HELL with Walmarts! Walmarts could care less about their employees! This family should sue.
If the crowd was pushing against the metal doors so hard, they torn it down. Why in the hell would you send an employee into that crazy crowd.

Money Money Money   December 3rd, 2008 - 11:30 pm

Money Money Money Money — that’s what it will all be about and it will be the attorney with the Botox’d eyebrows that will end up with most of it. Sue the idiots in the crowd. Crowd control — to get into a Walmart — to shop?? How ridiculous. How ashamed all of the people should be who were a part of this crowd — pushing forward — you know who you are — pony up your money for this man. And, why didn’t he get out of the way? Good grief. What is inside Walmart worth putting yourself in front of a crowd? And, why would he care whether 2 or 2000 people swarmed the place or broke down the doors. Unbelievable stupidity — but — yeah — let’s Walmart foot the bill. That’s the American way. Of course not one soul in the crowd could possibly be responsible? Walmart didn’t control their little bodies and we shouldn’t expect them to control their bodies. Not when there’s Walmart shopping to do!!! Get out of my way!!! Let me in!! I gotta buy my tree and my ornaments and my presents and my computer and my camera and my cigarettes!!

Trent   December 4th, 2008 - 12:08 am

What was this African doing there anyway? Go back to Africa and sue from there.

Neal E   December 4th, 2008 - 8:02 am

Walmart should have had barricades setup for no more than two or three people wide at the entrance. The guy didn’t have time to get out of the way. They pushed the doors open as soon as they were unlocked.

You can’t advertise a big sale, on a few items in stock, tell shoppers to “Come early!” and not expect a frenzied crowd.

I say sue thier a$$ess off!

Show me the Money   December 4th, 2008 - 2:18 pm

I blame the crowd 75% and WalMart 25%. That crowd must of been the biggest bunch of fat sow losers in the world. I can see why Obama got elected. This must of been an Obama crowd. Bunch of jerks. I hope someone can figure out who they are and then the police nail their sorry as***s to the wall. But the victim could of had some other health problems. Maybe more will come out of this. The know the shoppers had mental health problems and I’m sure they were a bunch of losers.
