This an example of the problems that we will be facing as a society because of the fragmented nature of laws regarding Homosexuality.
If a state does not acknowledge same sex unions then
the partner is on shaky ground as state rights could be invoked as the reason for denial of access.
If the union is not considered legal in that state then the hospital has no legal reason to allow access.

There is much more to this story than is being told by the media. What ever happened to balanced reporting of the facts? This was simply an emotionally charged piece aimed at stirring the pot. One sided reporting is essentially propaganda.

How could they be so cruel to a person? Regardless on ones stance on homosexuality, denying her legally adopted children the chance to visit their mother before she died is plain wrong. Hospital policy may (even legally) deny her partner that right, but not the children!

Sorry, Airwick it was a cbs story.
Public Health Act protects privacy and kept these two apart.
When the power of attorney was provided she was given access as she should have been.
She was luckey it only took 8 hours to go thru the system and get that approval.
As I see it the hospital did the right thing by law.
Sorry situation though.

it is very apparent that there is more to this story, there always is more to any story. in this day and age , for any person to draw a solid conclusion just from this story (either way), is solely emotional based on your existing feelings. in other words what passes as journalism these days !

Jack: They had the legal paperwork in order and had it faxed by a friend who raced to their house and retrieved it. They did the legal planning. Watch the piece or read any of the coverage by AP, UPI, the local stations, local press, etc. No one cared.
Within that paperwork, Lisa had given Janice the power of attorney and the right to make medical decisions should she be unable to do so for herself including donting her organs. Four people, including a twelve year old, benefited from that selfless act as her organs were harvested, matched and went to complete strangers.
Isn’t that what you all should be talking about instead of anonymous, ugly and snide comments about people who don’t know. I will bet if you, your child or loved one needed an organ in order to live you would not care who that person loved. You would just be grateful that they cared more for you than you obviously did for her.

Hospitals have no other choice; they have to abide by the laws.
All unmarried couples need to have a Power of Attorney and carry a copy with them at all times.

Even though I strongly disagree with most gay issues, these women had planned written Powers of Attorney to whom would be trusted with their medical decisions! Although I’m not an attorney, I would state emphatically that the presentation of the document “trumps” or supercedes any recognition of gay unions. At that point where the faxed document was received and verified if allowed under Florida law, the partner should have been given immediate access to assess the situation first-hand due to her LEGAL standing in the matter. Whether the children should have been granted immediate access could be subject to debate, but I won’t grant much leeway if I were judging this. I would predict if the statements hold true that the hospital will likely have to settle or be drug into something very expensive and embarassing, even if gay union issues aren’t mentioned!

I think this is a shame and I think that anyone who would rejoice in this situation could not really be considered a Christian. Regardless of the relationship it was known that this group lived as a family and they should have been given access. The ability of the partner to give medical directives might have been in doubt until the proper paperwork arrived but, barring any medical reason or objection by the patient, empathy and understanding should have dictated the need for “family and friends” to visit and comfort someone they loved and cared for. It is commonly done even for non-related people. The fact that it wasn’t allowed speaks volumes about the people in charge. Short of arresting and jailing me there isn’t anyone who would be able to keep me from paying my last repects to any of my loved ones. This is a black eye on the hospital and the employees who perpetrated it. I agree that money will not redress this but the ability of the parties to sue for access has passed and like it or not the way to stop this is to punish the intities involved enough to change their policy. This had little to do with the law and much to do with the power and prejudice of people and institutions.
I am a Republican and a conservative who does not want to see an amendment for “Gay Marriage”. I do not find it to be needed when it can be addressed in strictly legal ways. A Gay couple should be allowed to have legal civil unions with all the same legal rights as any married couple. As I see it marriage is really a historical function of religion and was adopted as a legal instrument. There is no reason for government to administer marriage only acknowlege it legally. It could and should be identical to any civil union in the government’s view.

What is hard to understand:
1. HOW did the hospital staff know that they were NOT RELATED?
2. Was it “something” about their appearance and/or actions??
In other words, did they “flaunt” their homosexuality & alternative lifestyle, to bring on this judgment from hospital personnel? Maybe they should’ve tried harder to “Don’t Ask, Don’t Tell,” and just go about their lives?
3. Whenever spouse or I need hospital care or medical tests, we always ask of personnel, “Can my (spouse) come in too?” and they always say SURE.
They don’t stop and say, “LET’S SEE YOUR I.D.!”
etc.
The point: If these women did not appear to be UNRELATED, maybe they could have been allowed to be together. She could have said “I need to be with my SISTER” or some such thing, and probably would’ve been admitted access immediately.
It is a sad story, but some of these “problems” are BROUGHT ON by the IN-YOUR-FACE ATTITUDES of the homosexuals in question.
Regardless of whether or not the gay “spouse” was allowed access, it is hard to understand why the legally adopted kids were NOT allowed access. Sounds like this woman will win the inevitable legal battle. Sounds like everyone involved screwed up–including the so-called “spouse.”
This is probably a good case for ALL gays to study and realize: Just because some states manage to wrangle (at least temporary) “legal status” for homosexuals to marry, don’t expect the ENTIRE COUNTRY to be as open and liberal and accepting of your supposed “marriage” as your particular state.

Maybe if this woman had LESS of a HIGH-PROFILE GAY APPEARANCE/DEMEANOR, she could’ve just gone ahead and been with her “spouse”/partner without a lot of hubbub by simply saying, “I’m family. She’s my sister… or aunt…” or whatever.
Whenever we have a medical situation, we always ask, “Can my spouse come along too?” and the nurses & doctors & lab techs etc. always say “Sure!” They do not ask for any identification or proof that we are married.
Maybe a little less “flamboyance” would result in an easier time for people such as this couple.
